These General Terms and Conditions of Business govern the services, rights and obligations between the Customer (hereinafter “CUSTOMER”) and Maldives Boat Club Pvt Ltd, M. Narugismaage-aage, Alhivila Magu, Male’ 20292, Maldives (hereinafter VZ Maldives).
This Website is provided only to assist customer in making reservations, confirming bookings, checking on our availabilities.
1. Subject of the contract:
1.1. Without variation of any/all the terms, conditions and notices set forth below is offered to CUSTOMER conditionally upon approval. Therefore by accessing or using the website in any manner, CUSTOMER agree to be assured of the following agreement. If CUSTOMER is accessing or using please make sure to read the agreement thoroughly.
1.2. Without any prior notice VZ Maldives reserves the right at anytime to modify the agreement at our sole discretion and the continuation of your access to this website indicates your acceptance of the latest updated agreement.
1.3. VZ Maldives acts as a seller of safari dive / surf / charter tours in the Maldives. VZ Maldives intends to sell tours to the CUSTOMER; the customer intends to book tours using the web page. The CUSTOMER is aware that all tours offered are organized and carried out by VZ Maldives.
2. Terms of payment:
2.1 A down payment of 30% of the total price becomes due immediately when reservation is confirmed. The remainder of the amount is due at the latest 60 days before commencement of the trip. If the booking is made within the 60 day deadline before the start of the trip, the entire price of the trip is due immediately after receipt of the written travel confirmation. If the entire amount has not yet been paid in full when travel commences, MBC reserves the right to prevent the CUSTOMER from commencing the trip or to demand the outstanding residual payments locally.
2.2 In order to make a payment you must possess a valid credit or debit card issued by a bank acceptable to MBC. MBC retains the right to refuse any request made by CUSTOMER. When making a payment CUSTOMER undertake that all details provide are true and accurate, that THE CUSTOMER are an authorized user of the credit or debit card used to make the payment and that there are sufficient funds to cover the payment.
2.3 Payments shall be made through a linked payment gateway and will be processed directly by the Bank of Maldives Plc (the “Bank”) using Secure Socket Layer (SSL) technology. MBC will not have access to your credit or debit card details.
2.4 Upon receiving CUSTOMER order the Bank will carry out a standard pre-authorisation check on the payment card to ensure that there are sufficient funds to fulfill the transaction. When CUSTOMER completes the online payment, funds will be deducted from the credit or debit card in the selected currency.
2.5 It is the cardholder’s responsibility to retain copies of transaction records and Website policies and rules.
3. Booking process
3.1. Bookings and reservations can be made by e-mail, verbally, by telephone or the VZ Maldives web page. However, a legally valid contract does not come into effect between the CUSTOMER and VZ Maldives until VZ Maldives has issued a corresponding booking confirmation and the necessary down payment / total payment pursuant to Point 2.) of these General Terms and Conditions of Business has been made by the CUSTOMER.
4. Cancellation
4.1 If the CUSTOMER withdraws from the travel contract before the start of travel or if he or she does not appear at the start of travel, the flat-rate cancellation conditions are as below. These conditions are published in the booking documents or on the website.
• Cancellation after confirmed reservation 30% of the confirmation invoice will be charged.
• Cancellation within 90-60 days 50% of the confirmation invoice will be charged.
• Cancellation within 60-0 days or last minute 100% of the invoice will be charged.
5. Travel Destination
5.1. VZ Maldives trips includes travelling various destinations within Maldives. VZ Maldives urges you to acquire all information regarding the trip
6. Expectations:
6.1. The following are subject to change without any early notice:
• Contract prices due to change in fuel prices, taxes, exchange rate, cost of food etc.
• Availability
• Itinerary
• Terms and Conditions ( eg: cancellation policy)
6.2. VZ Maldives is not responsible for events which are beyond control, such as flight delays, weather conditions, etc.
7. Client
7.1 The CUSTOMER who makes a booking for himself/herself or for third parties is deemed to be the client and in the lack of any declaration otherwise assumes the obligations from the issuing of the contract towards VZ Maldives (payments, cancelation etc.).
8. Travel conditions
8.1 It is deemed to be known that for travel abroad a valid passport is generally necessary that must be valid for 6 months beyond the date of departure. As a fundamental principle, the CUSTOMER is responsible himself/herself for complying with valid travel regulations and must obtain information from the relevant authority with regard to the validity of his/her passport. Reference is explicitly made to the fact that the import of drugs, alcohol, pornography, as well as of religious materials, is punished unusually severely in the Maldives. In addition, it is pointed out that the export of maritime animals, shells and corals is subject to strict checks and penalties.

11. Protecting Your Security
11.1 To certify that CUSTOMER’S belonging (Visa, AMEX and Master) card is not being used without CUSTOMER’S compliance, MBC may justify your name, address and contact number supplied by you during the booking process against appropriate third party databases. All information provided by CUSTOMER to VZ Maldives is securely processed in strict accordance with the Data Protection.
12. Site Usage and Product / Service Purchase
12.1 Be responsible for any booking made by person under your direction or control. Also be assured that all the information shared by the CUSTOMER or on behalf , or by family members in using this site is true and confidential. Without restriction any false or fraud reservation of demand is illegal. Our travel reservation services/ facilities in this site is only to make genuine reservations, misusing of our site will result in you being denied access.
13. Communication
13.1 Approval of our terms and conditions CUSTOMER IS permitting VZ Maldives to communicate to you in the form of messages, email, skype, phone call or any other instant communication method. All those communication will be protectively saved for customer service or later use.
14. Illegal or prohibited use
14.1 As a condition of use, CUSTOMER guarantees VZ Maldives that there will be no misuse of our website, data scrapping, numerous scans or screen scrapping. If VZ Maldives find of any, actions will be taken and we have the authority to terminate from our website.
15. Copyright and trademark notices
15.1 VZ Maldives have the ownership of the copyright of all material displayed on this website. Anyone accessing this website may view and print material from this website for information purposes only. Any copyright material of this website is strictly restricted to non-commercial use only and must include this copyright notice.
16. Notifications
16.1 All notifications and declarations of the CUSTOMER that relate to the contractual relationship must be done in writing by post, fax or e-mail.
17. Mutual acceptance
17.1 Through the conclusion of reservations, bookings and payments and/or acceptance of travel documents, both VZ Maldives and the CUSTOMER declare these General Terms and Conditions of Business to be the only valid contractual provision.
18. Severability clause
18.1 If one of the clauses in this contract should be invalid, this shall not affect the validity of the agreements as a whole. The invalid clause is then agreed to be replaced by a clause that comes as close as possible commercially to the invalid clause in a legally valid manner.
19. Place of jurisdiction
19.1 In the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the Maldivian courts.
